During my decades working in real estate, I have worked with many clients who have had their residential property as part of a trust. I am often asked if it is the best thing to do. I sat down with one of the top escrow officers in Orange County, Paula Vinnedge, to discuss trusts. David: As a homeowner, why is it desirable to put your home into a trust? Paula: One of the key reasons people put their home in a trust is because the assets in a trust do not have to go through probate upon death [of the homeowner(s)]. If you own a home, it is a good idea to put the property in a trust now to save loved ones time, head- aches, and the cost of the probate process. David: Is it harder to sell your home if it is in a trust? Paula: Generally, there is no difficulty in selling your home when it is in a trust, depending on the language that is built into the trust agreement. David: So, if someone who has their home in a trust were to refi- nance their home, do they need to do anything with their trust? Paula: The title company will require a signed and notarized trust certification in order to es- tablish the existence of the trust and its expressed authority. The trust agreement dictates the pow- ers of the trustee and what course shall be followed in the series of events that occur upon death. The lender may also require the borrower to deed the property out of the trust for loan purposes. Just be sure that the property is returned to the trust after the refinance process. If you have any other questions regarding the sale of your home, or the trust agreement process, talk to your real estate profes- sional. Art League hosts “A Value Approach to Watercolor” The Tustin Art League will feature watercolorist Andy Evan- sen at its Zoom meeting, Thurs., March 9 from 1 to 3 p.m. Evansen will demonstrate his use of value studies to simplify a subject, and connect shapes through lost edges that allow the beauty of watercolor to shine. He is a signature member of the Plein Air Painters of America, has been featured in many pub- lications, and paints and teaches internationally.
